Recherches inc., (“Your Folks”, “we” or “us”) operator of this website: https://www.yourfolks.com/ and https://www.mesaieux.com/ (the « Website »), recognizes the confidentiality of information that may be shared and submitted by its members in registering or making purchases from our Website and we are firmly committed to protecting your privacy. This Privacy Policy (“Privacy Policy,” or “Policy”) describes the ways in which Your Folks protects the privacy, integrity, and the confidentiality of personal information within our business and outlines the types of personal information that we may collect, how we collect personal information and how it is used; it does not apply to personal information collected from employees or job applicants.

OVERVIEW

'Personal information' means information that, for example, is provided to Your Folks at member registration, or in changing the content of 'my account', or at a purchase.

When the term “personal information” is used in this Policy it means any information that is linked or linkable to, or is about, an identifiable individual.

However, we may seek consent to use and disclose personal information after it has been collected in those cases where we wish to use the information for a new or different purpose where you have not already consented to such a use of your personal information.

HOW WE COLLECT PERSONAL INFORMATION

Your Folks will collect personal information when you sign-up as a member, or when you make a purchase (for example, buying a package). We may ask for similar information at other times, such as when you enter contests or other promotions sponsored by Your Folks and/or our many partners. The information we collect is your first and last name, mailing address, and email address. We also collect your mailing address and phone number if you make a professional genealogy order.

When you use your credit card for a payment, you submit it to our payment service provider. Your Folks does not collect or store your credit card information.

You may also provide additional information about you (such as your date of birth, marital status, and other information) when you are building your family tree. We do not use this information other than to display the content of the tree to you and the people you authorise to view your tree.

If you submit the names of other individuals and information you have about them, including their date of birth, death, and relationships with other individuals, please note that we do not control this information or use it other than to display and provide the tree to you and the people you authorise to view your tree. Please ensure you have the consent of those individuals before entering any information, and do not submit any sensitive information, such as health information.

HOW DOES YOUR FOLKS USE MY PERSONAL INFORMATION?

Our goal is to provide you with the most personalized, relevant, user-friendly Web experience possible. The primary use of all your personal information is to efficiently provide you with relevant information or services. How we use your information will depend on the services you request.

When you build your family tree, we will use that information to display the tree to you. We will not disclose the tree to anyone but you, unless you decide to share the tree with another party.

If you choose a premium service, we will use your information to conduct research for you on your ancestry by searching our database for potential matches with the information you provide. We may also use this information to build and present you with a professional tree.

We will also use your information to:

  • To process your requests and orders;
  • To ship the products you order;
  • To manage billing and process payments;
  • To process and resolve complaints;
  • To provide personalized recommendations based on buying behaviour, if you accepted cookies;
  • To communicate with you in the course of our activities, for the purposes of internal quality assurance or to manage the quality of the information provided;
  • To detect and prevent fraud;
  • For statistical, tax and accounting purposes (in these cases, personal information is aggregated and anonymized);
  • To inform you of news, updates, information and special offers concerning our products and services, in accordance with anti-spam legislation and with your express consent as required;
  • If we have reasonable grounds to believe that it might be useful as part of the investigation of a violation of applicable federal, provincial or foreign law or to ensure the protection or defence of a legal interest;

Your Folks will also use registration information to let you know about new features or other offers of interest from Your Folks, or to address customer service needs and requests.

Your Folks does not sell, rent or otherwise distribute personal information you provide us.

WILL YOUR FOLKS DISCLOSE ANY OF MY PERSONAL INFORMATION TO THIRD PARTIES?

Your Folks will not disclose any of your personal information, except with your knowledge and consent, or as described in this policy or as may be required by law, or to protect the rights or property of Your Folks.

Other circumstances where limited personal information may be disclosed are specifically described when the data is collected, or in the rules of contests or other promotions. So, in all cases you control what, if any, information you disclose.

Your personal information is disclosed only to our authorized employees who have a business need to access it, for example: our customer service centre, billing department and personnel responsible for providing products and services to our customers.

Your Folks reserves the right to disclose aggregated user statistics, and aggerated demographic information, in order to describe our services to prospective partners, advertisers, and other third parties.

Additionally, if you click away from Your Folks to visit the site of any third-party advertiser or sponsor, you may be asked for your credit card or other personal information in order to purchase or use products and services offered. These companies have their own privacy and data collection practices. Your Folks has no responsibility or liability for these independent policies. You should therefore review their privacy policies carefully if you have concerns about how your information may be used.

Your Folks may access and/or disclose any personal information which it has collected if required or permitted to do so by law (for example, in order to comply with a legal requirement including but not limited to one imposed by a warrant, subpoena, court order or like instrument served on Your Folks or in urgent circumstances to protect the life, health or security of any person).

Where an individual submits a credit application, we will collect certain trade and bank references, and may confirm such references, and may collect additional information and/or disclose certain information to banks and/or credit agencies as necessary to complete the credit application process, in accordance with applicable law.

Your Folks may also disclose an individual’s personal information to any successor, or to a purchaser upon any sale of any of its businesses or substantially all of the assets used in any such businesses or a similar transaction.

Minors

It is our intention to comply with all applicable laws regarding children’s privacy and advertisements that target them. We do not seek to collect personal information about minors under 14 years of age without the verified consent of the person having parental authority or a tutor. However, if you believe that we do so, please let us know. If we wish to collect personal information about minors under 14 years of age, we will obtain consent directly from a person having parental authority or a tutor, in accordance with applicable laws.

WHERE DOES YOUR FOLKS KEEP MY INFORMATION?

Your Folks retains all personal information in the province of Quebec, in Canada, where our hosting and storage facilities are located. We use third-party service providers to assist us with customer communications and payment processing. We have agreements in place to protect your information in accordance with this Policy. No personal information is handled outside of Canada/Quebec.

WILL YOUR FOLKS USE MY INFORMATION FOR DIRECT MAILINGS?

Your Folks will send electronic mail to you, for the purpose of informing you of changes or additions to Your Folks, or of any related products and services, but only with your prior consent. You may unsubscribe to receiving these messages at any time by using the mechanism contained in the message.

HOW DOES YOUR FOLKS PROTECT MY INFORMATION?

Your Folks and its internet service provider endeavor to maintain appropriate physical, procedural and technical security with respect to its offices and information storage facilities, so as to prevent any loss, misuse, unauthorized access, disclosure, or modification of personal information. This also applies to our disposal or destruction of personal information.

The nature of these security measures varies by the sensitivity, quantity, distribution and format of the personal data collected, as well as by the storage methods used. Physical security measures include physical access restrictions such as secured storage areas with access granted only to authorized staff members. Organizational security measures include company policies and procedures, as well as appropriate training for staff members. Technical security measures include, but are not limited to, data encryption, firewalls, and data access controls.

MAY I ACCESS AND REVIEW MY PERSONAL INFORMATION HELD BY YOUR FOLKS?

Your Folks permits the reasonable right of access and review of your personal information held by us by allowing you to access account information via the "My Account" section of our site as well as on every purchase.

DOES YOUR FOLKS USE "IP ADDRESSES"?

We do not use your IP address and we do not keep it anywhere.

COOKIES AND YOUR FOLKS

Your Folks uses technology to track the patterns of behaviour of visitors to any of the Sites. Technology that allows you to be identified, located or profiled, including cookies, is deactivated by default. You must first accept such technology. You may refuse such technology, but if you do, some of the functionalities may not be available.

We also use cookies. A cookie is a small text file stored on the device that an individual uses to access the Site. The cookie is used to identify the individual whenever he or she returns to the Website. The information contained in the cookie is also used to tailor how the individual experiences the Website. Please note, by changing the settings of their web browsers, individuals can prevent cookies from being set, but doing this may prevent them from participating in certain activities available via the Website and they may not have access to all of the features of the Website. Refer to the browser “help” button on the device for how to do this. The Website currently do not respond to Do Not Track requests.

Your Folks may use the information collected from individual who browses the Website for the following purposes: (i) to better understand how the Website is(are) being used in order to improve upon the Website; (ii) to tailor how an individual experiences the Site(s) to the individual; and (iii) to investigate security incidents relating to the Website (for example, to investigate a denial of service attack on the Website.

CONTESTS AND PROMOTIONS

Your Folks may occasionally run contests or other special promotions in which we ask members or visitors for contact information (like an email address) or demographic information (like a zip code, age, or income level). We use this data to send you promotional material about our company or our partners. Your contact information is also used to contact you when necessary and may be shared with other companies for promotional purposes, but only with your prior consent and under the terms and conditions specified when you take part in the promotion.
